
Lawsuit Regarding Roblox’s Charli XCX Dance Emote Concluded Successfully
A legal dispute over an emote based on Charli XCX's Apple dance in Roblox has been resolved amicably, with both parties agreeing to drop the case.
The emote had been added as part of a Dress to Impress update.
Influencer Kelley Heyer’s lawsuit against Roblox Corporation has been amicably resolved, per court papers filed in the US this week. The two sides have agreed to dismiss the case, which centered around an in-game emote based on the choreographer’s viral dance set to Charli XCX’s song, Apple.
The Apple dance gained immense popularity on TikTok in the summer of 2024 and was even performed by Charli XCX herself. Heyer showcased the dance live at one of the star’s concerts. The emote was incorporated into a Charli XCX-themed “Brat” update for Roblox’s game, Dress to Impress.
Initially, discussions about licensing the dance took place in early August, but the update incorporating the emote was released prior to any signed agreement, leading Heyer to copyright the dance. Her lawsuit claimed Roblox earned approximately $123,000 from emote sales between August and November 2024, asserting that she, as an independent creator, deserved fair compensation.

Heyer has expressed her enjoyment in seeing others perform the dance but felt disappointed that major brands utilized it without proper credit.
